 Part I Amendment of Law for England and Wales and Northern Ireland 第一部分 英格兰、威尔士和北爱尔兰的法律修正案

 1 Scope of Part I 1 第一部分的适用范围 (1) For the purposes of this Part of this Act, “negligence” means the breach— (1) 就本法的这一部分而言,"疏忽 "是指违反了

 (a) of any obligation, arising from the express or implied terms of a contract, to take reasonable care or exercise reasonable skill in the performance of the contract; (a) 违反了由合同的明示或默示条款产生的任何义务,即在履行合同时采取合理的谨慎或行使合理的技能。

 (3) In the case of both contract and tort, sections 2 to 7 apply (except where the contrary is stated in section 6(4)) only to

 (4) In relation to any breach of duty or obligation, it is immaterial for any purpose of this Part of this Act whether the breach was inadvertent or intentional, or whether liability for it arises directly or vicariously. (4) 就任何违反责任或义务的行为而言,就本法本部分的任何目的而言,该违反行为是无意的还是故意的,或者其责任是直接产生的还是替代产生的,都无关紧要。

 2 Negligence liability 2 过失责任 (1) A person cannot by reference to any contract term or to a notice given to persons generally or to particular persons exclude or restrict his liability for death or personal injury resulting from negligence.

 (1) 一个人不能通过援引任何合同条款或向一般人或特定人发出的通知来排除或限制他对过失造成的死亡或人身伤害的责任。

 (2) In the case of other loss or damage, a person cannot so exclude or restrict his liability for negligence except in so far as the term or notice satisfies the requirement of reasonableness. (2) 在其他损失或损害的情况下,一个人不能如此排除或限制他对疏忽的责任,除非该条款或通知符合合理性的要求。

 (3) Where a contract term or notice purports to exclude or restrict liability for negligence a person’s agreement to or awareness of it is not of itself to be taken as indicating his voluntary acceptance of any risk. (3) 如果合同条款或通知意在排除或限制过失责任,某人对其的同意或知悉本身并不表示他自愿接受任何风险。

 3 Liability arising in contract 3.因合同而产生的责任

 (1) This section applies as between contracting parties where one of them deals as consumer or on the other’s written standard terms of business. (1) 本条适用于缔约各方之间,其中一方作为消费者或根据另一方的书面标准商业条款进行交易。

 (2) As against that party, the other cannot by reference to any contract term— (2)对该一方,另一方不能援引任何合同条款-

 (a) when himself in breach of contract, exclude or restrict any liability of his in respect of the breach; or (a) 当他自己违反合同时,排除或限制他在违反合同方面的任何责任;或 (b) claim to be entitled— (b) 有权提起索赔 (i) to render a contractual performance substantially different from that which was reasonably expected of him, or (i) 使合同的履行与人们对他的合理期望有很大不同,或

 (ii) in respect of the whole or any part of his contractual obligation, to render no performance at all, except in so far as (in any of the cases mentioned above in this subsection) the contract term satisfies the requirement of reasonableness.  4 Unreasonable indemnity clauses 4 不合理的赔偿条款

 (1) A person dealing as consumer cannot by reference to any contract term be made to indemnify another person (whether a party to the contract or not) in respect of liability that may be incurred by the other for negligence or breach of contract, except in so far as the contract term satisfies the requirement of reasonableness.  (2) This section applies whether the liability in question—

 5 "Guarantee" of consumer goods 5.对消费品的“保证”

 (1) In the case of goods of a type ordinarily supplied for private use or consumption, where loss or damage— (1) 对于通常供私人使用或消费的货物,如果损失或损坏 (a) arises from the goods proving defective while in consumer use; and (a) 产生于在消费者使用中被证明有缺陷的货物;和

  (b) results from the negligence of a person concerned in the manufacture or distribution of the goods, liability for the loss or damage cannot be excluded or restricted by reference to any contract term or notice contained in or operating by reference to a guarantee of the goods.  6 Sale and hire-purchase 6 销售和租购

 (1) Liability for breach of the obligations arising from— (1)违反义务的责任-

  (a) section 12 of the Sale of Goods Act 1979 (seller’s implied undertakings as to title, etc); (a) 《1979 年货物销售法》第 12 条(卖方对所有权的默示承诺等)。
